1. Purpose and Scope
This Consumer Health Data Privacy Policy explains how Mica Health Ventures, LLC (d/b/a Mica Peak Health) (“Mica Peak,” “we,” “us”) collects, uses, and shares “consumer health data” as defined by the Washington My Health My Data Act, and provides comparable disclosures for residents of other states with consumer health data laws (such as Nevada and Connecticut). It is separate from, and in addition to, our general Privacy Policy. It does not cover protected health information handled by Empathra Medical P.C. under HIPAA, which is addressed in that practice's Notice of Privacy Practices.
2. Categories of Consumer Health Data We Collect
Depending on the services you use, we may collect consumer health data including:
- Health conditions, symptoms, and status you report (for example, related to weight, hormones, sexual health, or hair).
- Treatments, medications, and the services you seek or receive, including whether you use weight-management, testosterone, hormone, sexual-health, or hair services.
- Measurements and intake responses you provide (such as height, weight, and medical history).
- Information that identifies you as having sought health services, and data derived or extrapolated from the above.
3. Why We Collect and Use Consumer Health Data
We collect and use consumer health data to: connect you with Empathra Medical P.C. and facilitate the telehealth services you request; verify your eligibility and identity; arrange prescriptions and fulfillment through Pharmacies; process payments for services; communicate with you about your care and account; maintain security and prevent fraud; and comply with legal obligations. We collect only what is necessary to provide the services you request or as you otherwise consent.
4. Sources of Consumer Health Data
We collect consumer health data directly from you (through intake forms, the patient portal, and communications), automatically through your use of the Services, and from service providers and partners (such as the Medical Group, Pharmacies, and identity-verification or payment vendors) that help deliver the Services.
5. With Whom We Share Consumer Health Data
We share consumer health data only as needed to provide the services you request and as described here. We share it with the following categories of recipients and specific affiliates and third parties:
- Affiliated medical practice: Empathra Medical P.C., the independent professional entity whose clinicians provide your care.
- Pharmacies: the independent compounding, retail, and manufacturer-affiliated pharmacies that fill prescriptions (for example, NovoCare and LillyDirect for certain branded products).
- Service providers: vendors that process data on our behalf under contract, including cloud hosting, payment processing, identity verification, secure communications, and customer support providers.
- Legal and safety recipients: authorities or parties where required by law or to protect rights and safety.
- Business-transfer recipients: a successor entity in a merger, financing, acquisition, or sale of assets, subject to this policy and applicable law.
We do not sell consumer health data and we will not sell it without your separate, valid written authorization as required by law. We do not share consumer health data for targeted or cross-context advertising, and we do not use geofences around health-care facilities to collect it.
6. Your Rights
Subject to legal exceptions (such as records the Medical Group must retain under medical-records laws), you have the right to:
- Confirm whether we are collecting, sharing, or selling your consumer health data and access that data.
- Withdraw your consent to our collection and sharing of your consumer health data.
- Have your consumer health data deleted, including, where applicable, by our service providers.
7. How to Exercise Your Rights
To exercise these rights, email us at legal@micapeakhealth.com with “Consumer Health Data Request” in the subject line, or write to Mica Health Ventures, LLC (d/b/a Mica Peak Health), 522 W Riverside Ave Ste N, Spokane, WA 99201. We will verify your request through your account email and respond within the time required by law. If we deny your request, you may appeal by replying to our decision; if your appeal is denied, Washington residents may contact the Washington State Attorney General.
